These Terms of Service apply to all orders and purchases made through the online shop garlikgoods.de, operated by Garlik Goods (hereinafter "we", "us" or "our"). Garlik Goods offers individually printed print-on-demand t-shirts through this website, including all related content, features and services (the "Services"). The shop is technically operated on the Shopify platform.
The following Terms of Service, together with all policies referenced herein (these "Terms of Service" or "Terms"), describe your rights and obligations when using the Services.
Please read these Terms carefully as they contain important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.

SECTION 2 – OUR PRODUCTS
We have endeavored to display our products in our online shop as accurately as possible. Please note, however, that colors or the appearance of products may differ from the display on your screen due to the type of device you use and your device settings.
All product descriptions may be changed at any time without prior notice at our sole discretion. We reserve the right to discontinue any product at any time and to limit the quantities of any products we offer.

SECTION 3 – ORDERS
When you place an order, you make an offer to purchase. The contract is concluded when Garlik Goods confirms your order (order confirmation email). We must receive and process your payment before your order is accepted. Please review your order carefully before submitting. Since our products are manufactured individually (print-on-demand), cancellation after production has started may not be possible.
If we are unable to accept your order, we will notify you using the contact information provided with the order.
Your purchases are subject solely to our Return Policy on this website regarding returns or exchanges.

SECTION 4 – PRICES AND BILLING
Prices, discounts and promotions may be changed without prior notice. The price charged for a product is the price in effect at the time of your order and will be listed in your order confirmation email. All prices shown in our shop include applicable VAT (value-added tax). Shipping costs are displayed separately during checkout.
We may from time to time offer promotions through the Services that may affect pricing and are subject to their own terms. In the event of a conflict between the terms of a promotion and these Terms, the terms of the promotion shall prevail.
You agree to provide current, complete and accurate purchase and payment information for all purchases. You agree to promptly update your information so that we can complete your transactions and contact you as needed.

SECTION 5 – SHIPPING AND DELIVERY
All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs clearance or events beyond our control.
For deliveries to consumers within the European Union, the risk of accidental loss or deterioration of the goods passes to you upon delivery. Until the goods are delivered to you, we bear the risk of loss during transport.

SECTION 6 – INTELLECTUAL PROPERTY
Our Services, including but not limited to all trademarks, trade names, texts, images, graphics, product designs, videos and audio content, and their design, selection and arrangement, are the property of Garlik Goods, its affiliates or licensors and are protected by German, European Union and international intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store or transmit any material from the Services without our prior written consent. All rights not expressly granted herein are reserved to Garlik Goods.
The names, logos, product and service names, designs and slogans of Garlik Goods are trademarks of Garlik Goods or its affiliates or licensors. The name, logo and trademarks of Shopify are the property of Shopify Inc.

SECTION 7 – OPTIONAL TOOLS
As part of the Services, you may be given access to third-party tools that we neither monitor nor control.
You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations or conditions of any kind. We shall have no liability arising from your use of optional third-party tools, to the extent permitted by law.
Any use of the optional tools offered through the website is entirely at your own risk and discretion.
We may also offer new features through the Services in the future. Such new features shall also be considered part of the Services and subject to these Terms.

SECTION 9 – RELATIONSHIP WITH SHOPIFY
Garlik Goods is powered by Shopify, which enables us to provide the Services to you. However, all sales and purchases you make in our shop are made directly with Garlik Goods. By using the Services, you acknowledge that Shopify is not a party to the contract between you and Garlik Goods and is not responsible for any aspect of sales between you and Garlik Goods.

SECTION 10 – PRIVACY POLICY

This limitation of liability does not apply to: (a) liability for damages arising from injury to life, body or health caused by negligence or intent; (b) liability for other damages caused by intentional or grossly negligent breach of duty; (c) liability under mandatory statutory provisions, including the German Product Liability Act (Produkthaftungsgesetz); or (d) liability arising from breach of essential contractual obligations (Kardinalpflichten), where liability is limited to the foreseeable, typically occurring damage.
Nothing in these Terms excludes or limits any mandatory rights you have as a consumer under applicable law.

SECTION 17 – RESPONSIBILITY OF THE CUSTOMER
You are responsible for the accuracy of the information you provide when placing an order, in particular your shipping address and contact details. You are also responsible for complying with any applicable import or customs regulations when ordering from outside Germany.

If any provision of these Terms is found to be unlawful, void or unenforceable, such provision shall be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms. The remaining provisions shall remain in full force and effect.

These Terms, together with all policies referenced on this website, constitute the entire agreement between you and Garlik Goods regarding your use of the Services and supersede all prior or contemporaneous agreements or communications.

You may not assign, transfer or delegate any of your rights or obligations under these Terms without our prior written consent. We may assign or transfer these Terms and our rights and obligations without restriction.

SECTION 21 – GOVERNING LAW
These Terms shall be governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
If you are a consumer habitually resident in an EU member state, you also enjoy the protection of the mandatory consumer protection provisions of your country of residence. We agree to submit to the non-exclusive jurisdiction of the courts of your country of residence as well as the courts of Germany.
